Do You Need to File an Accident Claim?

When injured in a car accident, you might feel rushed or that you need to file a lawsuit quickly, but that may be a mistake. Filing too soon after an accident may mean going into settlement negotiations without all the facts at your disposal. You may not know the full extent of your injuries or the actual cost of recovery for several months. While you may have an urge to seek closure, hold off until you know more. You have time.

The Two-Year Statute

In most personal injury claims, which a car accident falls under, you have a minimum of two years from the date of the accident to file. However, some states allow more time and others less. It is best to contact a local personal injury attorney to discuss the statute of limitations.

Governmental Restrictions

While it is true that in most cases you can wait until you understand your injuries and the accident that caused them, if you were injured on public transportation, you might not have this luxury. Most states and federal regulations require that any pending suit be filed within months rather than years against a governmental body. You may only have up to 4 months to file your claim.

Minor Advantage

If the injuries sustained were to a minor, then they have more time. A juvenile has until they turn twenty in most states because the timeline does not start ticking until they turn 18. While there may be some flexibility in how long an individual has after they turn 18, most states give some leeway.

Extenuating Circumstances

Some people cannot file a lawsuit because they are incapacitated. The accident may have put them into a coma or other state. When this type of injury occurs, some jurisdictions will either allow a family member to file on the individual’s behalf or wait for the person to be alert and capable of deciding. Your attorney will know how to proceed in these circumstances.

Car accidents are never any fun and may leave you with serious injuries. If you sustain injuries during a wreck, do not rush to sue. You most likely have a minimum of two years to make that decision. Since many injuries do not present until several weeks after the initial crash, it is better to wait until you are entirely aware of your injuries.

Be Cautious of Car Accident Settlements

Any car accident ruins your day. Whether you were heading home from work or out running errands, hearing that smash of metal is terrifying. It can also leave you with serious injuries.

When that happens, you deserve compensation to help you get better. A lawyer, like a car accident lawyer from Barry P. Goldberg, can help guide you through the process to help you maximize your compensation.

Car Accident Causes

There are many causes of car accidents. Most are caused by some human error, including:

  • Driving under the influence of drugs or alcohol
  • Distracted driving
  • Drowsy driving
  • Failure to yield
  • Speeding
  • Aggressive driving

No matter what caused your car accident, it’s important to remember that you did not play a part. Because of that, you should also not bear any responsibility for the medical bills you may face to help recover from your injuries. That should be the sole responsibility of the at fault party. The best way to help hold that person accountable is to work with a seasoned personal injury lawyer.

Settlement Offers

Settlement offers can sometimes come quickly. This may give you some hope that the end is near. But it’s those quick settlements where we urge the most caution.

Your interests and the interests of the insurance company representing the at fault party are not aligned. Your interest is to maximize your financial recovery so you do not end up in financial hardship because of an accident you did not cause. The insurance company’s goal, however, is to keep as much money in their pocket and out of yours as possible.

They do this by offering you a quick, low ball settlement offer hoping you won’t consider all of your future expenses. If you sign the offer, you may even waive your right to bring any future claim against the insurance company for this accident. That means when you realize the settlement funds were not enough to cover all of your expenses, it’s too late.

But when you work with a trusted car accident injury lawyer, your interests are given the attention they deserve. As your lawyer, we can negotiate with the insurance company on your behalf and work hard to get you the compensation you need to get back on your feet.

Damages to Fight For

Collecting damages is one way you are able to minimize your financial responsibility for your injuries. You may be able to recover compensation for:

  • Pain and suffering
  • Emotional distress
  • Lost wages
  • Lost earning potential
  • Loss of companionship
  • Medical bills
  • Rehabilitation costs

To make sure you do not pay a dime out of your own pocket for these bills and financial losses, you need to hold the at fault party liable for your injuries. The best way to do that is to work with a trusted personal injury attorney who can aggressively defend your rights.

A Law Firm Gives You the Confidence You Deserve

Attorneys know it’s a confusing time after your accident. They have helped many clients just like you recover from their injuries, hold the at fault parties liable, and recover damages for their suffering. Contact a law firm today to get started.

Can I recover damages from broken glass in an auto accident?

Car Accident Lawyers

Any vehicular accident can result in a number of injuries including brain and head injuries, internal injuries, broken bones, and bruising. While all of these are common, one of the injuries that many people don’t think about are lacerations caused by broken glass.

A majority of car accidents will have some degree of broken glass from the windows or mirrors. When these things break upon impact they can shatter and fly in all directions. Even though windows and windshields are designed to resist complete shattering, it is possible for this to not work in a large collision or one that involves a high amount of speed. If your injuries are the result of broken glass, you may be able to recover compensation. It is advisable to call a car accident lawyer, like a car accident lawyer in Longwood, FL, to discuss the details of your case.

Broken Glass Injuries
Although window and windshield glass typically shatters into small pieces, it is still incredibly sharp. When these pieces are thrown around, they can hit the skin and cause deep lacerations. Sometimes the glass may even become impacted into the skin. Apart from the pain, it is possible for an infection or scarring to result. In some cases, the glass can cause excess bleeding which, if left untreated, may result in severe consequences that could be life-threatening. An experienced car accident lawyer will know of victims who suffered a high amount of lacerations in a single area and were even at risk for losing a limb.

Compensation for Broken Glass Injuries
Following a car accident, you may be faced with enormous medical bills along with emotional and mental distress. If broken glass caused you harm, it may be possible to recover damages. However, this will be dependent on the circumstances of your case and who was at fault. If another person caused the accident, it is very likely that a car accident lawyer will be able to recover damages for your economic and non-economic losses. Some of these may include:

  • Your related medical treatment
  • Future medical care
  • Cosmetic surgery or corrective surgery for scarring
  • Loss of income
  • Lost wages
  • Pain and suffering
  • Mental anguish

Punitive damages may also be available if a car accident lawyer believes the liable party acted maliciously or in a way that was grossly negligent. In general, these damages are only available if a case goes to trial, and only in very certain situations. A car accident lawyer can help  you to understand the available damages for your case, and give an estimated amount that may be recoverable.

The damages for your pain and suffering may be extensive as a lawyer will know that:

  • Shattered glass injuries tend to involve a lot of pain.
  • Shallow lacerations can cause long term damage.
  • Disfigurement and scarring is possible.

Generally, the more pain and suffering you have, the more you will be able to recover compensation for your losses. If you’ve been injured from broken glass in an auto accident, please call a car accident lawyer now.
